1. Introduction

These Terms of Service ("Terms") govern your access to and use of the KryptoMate platform, including our website, mobile applications, Telegram bot, and all related services (collectively, the "Platform"). By creating an account, making a purchase, or otherwise using our Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, our AML/KYC Policy, and our Refund Policy.

If you do not agree with any part of these Terms, you must not access or use our Platform. We reserve the right to update or modify these Terms at any time. Material changes will be communicated via email or a prominent notice on the Platform. Your continued use of the Platform after such changes constitutes acceptance of the revised Terms.

2. Description of Services

KryptoMate is a digital marketplace that enables users to purchase a wide range of digital products and services using cryptocurrency, credit/debit cards, and other supported payment methods. Our services include:

Gift Cards — Digital gift cards from over 5,000 global brands across entertainment, gaming, shopping, dining, streaming, and more, available in 70+ countries.
Game Credits & Keys — In-game currency, top-up credits, game keys, downloadable content (DLC), and software licenses for PC, Xbox, PlayStation, Nintendo, and other platforms.
eSIM Plans — Digital SIM cards providing mobile data connectivity in over 190 countries, with instant activation via QR code.
Mobile Top-Ups — Airtime and data recharges for mobile carriers worldwide, supporting 600+ operators across 150+ countries.
Flight Bookings — Domestic and international flight reservations through our integrated booking engine, powered by Amadeus GDS, with access to 500+ airlines.
Hotel & Stays — Hotel, apartment, and accommodation bookings worldwide through our integrated stays platform, with access to millions of properties across 200+ countries.
Airport Lounge Access — Digital passes for airport lounges across 1,300+ lounges in 650+ cities globally.
KryptoCard — Virtual prepaid payment cards funded with cryptocurrency, accepted at millions of merchants worldwide.
Wholesale — Bulk purchasing and API access for businesses, resellers, and enterprise clients requiring volume discounts and programmatic integration.

3. Eligibility

To use our Platform, you must be at least 18 years of age or the age of majority in your jurisdiction, whichever is higher. You represent and warrant that you meet these eligibility requirements and that your use of the Platform does not violate any applicable laws or regulations in your country or region.

Certain products and services may have additional eligibility requirements, geographic restrictions, or regulatory limitations. It is your sole responsibility to ensure compliance with the laws of your jurisdiction. KryptoMate reserves the right to restrict access to specific products or services based on geographic location, regulatory requirements, or risk assessment.

4. Account Registration & Security

To access certain features, you must create an account with accurate, current, and complete information. You are solely responsible for maintaining the confidentiality of your account credentials, including your password, passkeys, two-factor authentication methods, and any API keys issued for wholesale access.

You are responsible for all activities that occur under your account, whether or not authorized by you. You must notify us immediately at [email protected] if you suspect unauthorized access or any security breach. We reserve the right to suspend or terminate accounts that we reasonably believe have been compromised, are being used in violation of these Terms, or pose a security risk to the Platform.

You may not create multiple accounts, share account credentials with third parties, or transfer your account to another person without our prior written consent.

5. Pricing & Payments

All prices are displayed in USD equivalent unless otherwise specified. We support multiple payment methods, including cryptocurrency (BTC, ETH, USDT, USDC, SOL, TON, and other supported digital assets), credit/debit cards, and third-party payment processors. By initiating a transaction, you acknowledge that:

Cryptocurrency transactions are irreversible once confirmed on the blockchain.
You are responsible for ensuring the correct wallet address, network, and payment amount.
Exchange rate fluctuations may result in price adjustments between order placement and payment confirmation.
Network fees, gas fees, and miner fees are your responsibility and are not included in displayed prices.
Third-party payment processors (Binance Pay, KuCoin Pay, Bybit Pay, Gate.io) are subject to their respective terms and conditions.
Card payments may be subject to additional verification, 3D Secure authentication, or issuer restrictions.
Promotional pricing, discount codes, and special offers are subject to their specific terms and may be withdrawn at any time.

6. Order Processing & Delivery

Digital products are delivered electronically after payment confirmation. Delivery methods and timeframes vary by product type:

Gift Cards & Game Credits — Typically delivered instantly or within minutes via your dashboard and/or email.
eSIM Plans — QR codes and activation instructions delivered immediately upon payment confirmation.
Mobile Top-Ups — Processed and applied within seconds to minutes.
Flight Bookings — Confirmations and e-tickets delivered via email after airline confirmation, typically within minutes but up to 24 hours.
Hotel & Stays — Booking confirmations delivered via email after property confirmation, typically within minutes but up to 48 hours for certain properties.
Airport Lounge Access — Digital passes delivered to your account and email upon confirmation.
KryptoCard — Virtual card details available immediately after funding is confirmed.
Wholesale Orders — Delivered via API callback, dashboard, or email depending on integration method and order volume.

While we strive for instant delivery, delays may occur due to blockchain confirmation times, supplier processing, airline or hotel confirmation delays, or technical issues. Contact our support team if your product is not delivered within the expected timeframe.

7. Product-Specific Terms

7.1 Gift Cards

Gift cards are subject to the terms and conditions of the issuing brand or retailer. KryptoMate acts as an authorized reseller and is not responsible for redemption terms, expiration policies, balance limitations, or restrictions imposed by the card issuer. Gift cards are region-specific; it is your responsibility to purchase the correct region.

7.2 Game Credits & Keys

Game credits, keys, and DLC are subject to the terms of the respective game publisher or platform (Steam, Epic Games, PlayStation Store, Xbox, Nintendo eShop, etc.). Region locks, platform compatibility, age restrictions, and activation requirements are specified on the product page. Pre-order items are subject to the publisher's release schedule.

7.3 eSIM Plans

eSIM plans require a compatible, carrier-unlocked device that supports eSIM technology. Data allowances, validity periods, speed throttling policies, and coverage areas are as described on the product page. Once activated, eSIM plans cannot be transferred, paused, or extended unless explicitly stated. Device compatibility is your responsibility to verify before purchase.

7.4 Mobile Top-Ups

Mobile top-ups are processed through our carrier network partners. Once a top-up is successfully applied to the recipient number, it cannot be reversed. You are responsible for providing the correct phone number and selecting the appropriate carrier and country.

7.5 Flight Bookings

Flight bookings are subject to the operating airline's terms and conditions, including fare rules, baggage policies, cancellation terms, and change fees. KryptoMate acts as a booking intermediary and is not the airline. Schedule changes, delays, cancellations, and overbooking are governed by the airline's policies and applicable aviation regulations. Travel documents (passport, visa) are your responsibility.

7.6 Hotel & Stays

Hotel and accommodation bookings are subject to the property's terms and conditions, including check-in/check-out times, cancellation policies, house rules, and local taxes. KryptoMate acts as a booking intermediary. Property descriptions, photos, star ratings, and amenities are provided by the accommodation partner and may vary. Any disputes regarding property conditions should be raised with the property directly and with our support team.

7.7 Airport Lounge Access

Lounge access is subject to availability, capacity limits, and the lounge operator's terms. Access may be denied if the lounge is at capacity. Dress codes, age restrictions, and guest policies vary by lounge. Passes are valid only for the specified date, time, and location.

7.8 KryptoCard

KryptoCard virtual cards are issued by our card program partner and are subject to their cardholder agreement. Usage limits, accepted merchants, geographic restrictions, and spending caps may apply. KryptoMate is not a bank or licensed financial institution; the card program is operated by a licensed third-party issuer.

7.9 Wholesale & API Access

Wholesale accounts are subject to a separate Wholesale Agreement in addition to these Terms. API access is provided under a rate-limited, non-exclusive license. Misuse of API access, including excessive requests, scraping, or unauthorized redistribution, may result in immediate termination. Volume pricing, credit terms, and SLA commitments are defined in the individual Wholesale Agreement.

8. Intellectual Property

Digital products purchased through our Platform are licensed, not sold. You receive a limited, non-exclusive, non-transferable license for personal, non-commercial use unless explicitly stated otherwise (e.g., wholesale). All Platform content, including but not limited to text, graphics, logos, icons, images, software, and the compilation thereof, is the property of KryptoMate or its content suppliers and is protected by international intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any Platform content without our prior written consent.

9. Prohibited Activities

By using our Platform, you agree not to:

Use the Platform for unlawful purposes, including money laundering, terrorist financing, fraud, tax evasion, or sanctions evasion.
Purchase products for unauthorized commercial resale outside of an approved Wholesale Agreement.
Provide false, misleading, or fraudulent information during registration, verification, or transactions.
Attempt unauthorized access to other user accounts, Platform systems, servers, or networks.
Use automated scripts, bots, crawlers, or scraping tools to access or extract data from the Platform.
Engage in any activity that disrupts, impairs, or places an unreasonable burden on Platform infrastructure.
Circumvent security measures, geographic restrictions, rate limits, or access controls.
Exploit pricing errors, system glitches, or promotional loopholes in bad faith.
Use the Platform to facilitate any form of illegal gambling, illicit trade, or prohibited commerce.

10. Account Suspension & Termination

We reserve the right to suspend, restrict, or terminate your account at our sole discretion if we reasonably believe you have violated these Terms, engaged in fraudulent or suspicious activity, failed KYC/AML verification, or if required by law or regulatory order. Upon termination:

Your right to use the Platform ceases immediately.
Pending orders may be cancelled and refunded at our discretion.
Outstanding KryptoCard balances will be handled per the card issuer's terms.
Wholesale API access will be revoked immediately.
We may retain your data as required by law and our data retention policies.

11. Disclaimer of Warranties

The Platform and all products and services are provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, secure, or free of harmful components.

12. Limitation of Liability

To the maximum extent permitted by applicable law, KryptoMate, its directors, officers, employees, affiliates, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising from or related to your use of the Platform. Our total aggregate liability for any claim arising under these Terms shall not exceed the amount you paid to us in the twelve (12) months preceding the event giving rise to the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless KryptoMate and its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to your use of the Platform, your violation of these Terms, your violation of any applicable law, or your infringement of any third-party rights.

14. Third-Party Services & Integrations

The Platform integrates with and relies upon third-party services, including but not limited to payment processors (Binance Pay, KuCoin Pay, Bybit Pay, Gate.io), airline booking systems (Amadeus), hotel aggregators, eSIM providers, identity verification services, and blockchain networks. We are not responsible for the availability, accuracy, content, privacy practices, or terms of any third-party services. Your use of third-party services is at your own risk and subject to their respective terms.

15. Force Majeure

We shall not be liable for any failure or delay in performance resulting from circumstances beyond our reasonable control, including but not limited to natural disasters, acts of government or regulatory action, war, terrorism, pandemic, epidemic, blockchain network congestion or failure, internet outages, power failures, supplier disruptions, or labor disputes.

16. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which KryptoMate is incorporated, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms shall first be attempted through good-faith negotiation between the parties. If negotiation fails within thirty (30) days, the dispute shall be submitted to binding arbitration in accordance with the rules of the applicable arbitration body. Each party shall bear its own costs of arbitration unless the arbitrator determines otherwise.

17. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect. The invalidity of any provision shall not affect the validity of the remaining provisions.

18. Waiver

No failure or delay by KryptoMate in exercising any right, power, or remedy under these Terms shall operate as a waiver thereof. A waiver of any right on one occasion shall not be construed as a waiver of any right on any subsequent occasion.

19. Entire Agreement

These Terms, together with our Privacy Policy, AML/KYC Policy, Refund Policy, and any applicable Wholesale Agreement, constitute the entire agreement between you and KryptoMate regarding your use of the Platform. These Terms supersede all prior agreements, understandings, and representations, whether written or oral.
